1. Acceptance of Terms
By downloading, installing, activating, or using EV Puzzles (the “Plugin”), whether the free version or a paid Pro version, or by otherwise accessing any related service, website, or account provided by Entreveloper.com (collectively, the “Service”), you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, do not download, install, activate, or use the Service.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and “you” refers to that organization.
2. Definitions
- “Plugin” means the EV Puzzles WordPress plugin, including its free and Pro versions, and any related companion plugins, blocks, or add-ons.
- “Free Version” means the version of the Plugin distributed at no cost, including through the WordPress.org plugin repository.
- “Pro Version” means the paid, licensed version of the Plugin offering additional features.
- “License” means the right to use the Pro Version granted under a paid subscription or license key.
- “Account” means any account you create with us or with a third-party licensing/payment provider we use (e.g., Freemius) to manage your License.
- “Content” means any data, word lists, puzzles, images, or other material you create, upload, or generate using the Service.
- “Third-Party Services” means services not operated by us that the Plugin may connect to, including AI providers and payment processors.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to agree to these Terms. By using the Service, you represent that you meet this requirement.
4. The Service and License Grant
4.1 Free Version
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Free Version of the Plugin on any website(s) you own or control, for as long as you comply with these Terms.
4.2 Pro Version
Use of the Pro Version requires a valid, active license obtained through a paid subscription or one-time purchase, as described at https://entreveloper.com/pricing/. Your License is limited to the number of sites, and the license term, specified at the time of purchase. We may use a third-party licensing platform (e.g., Freemius) to issue, validate, and manage License keys and to process payments on our behalf.
4.3 Restrictions
You may not, and may not permit others to:
- Copy, modify, or create derivative works of the Plugin, except as permitted by the Plugin’s open-source license (if any) or applicable law;
- Reverse-engineer, decompile, or disassemble the Plugin, except to the extent such restriction is prohibited by law;
- Redistribute, resell, sublicense, rent, or lease the Pro Version, or share Pro License keys with third parties;
- Remove or alter any proprietary notices on the Plugin;
- Use the Service to build a competing product;
- Use the Service in violation of any applicable law or in a way that infringes the rights of others.
5. Accounts and Registration
Some features of the Service, such as managing a Pro License, may require creating an Account with us or with our licensing provider. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account.
6. Subscriptions, Fees, and Payment
6.1 Pricing
Current pricing for the Pro Version is available at https://entreveloper.com/pricing/. We reserve the right to change our prices at any time; changes will not affect subscriptions already in effect until their next renewal, except as required to comply with law.
6.2 Billing and Renewal
Paid subscriptions renew automatically at the end of each billing period ([monthly/annually]) unless canceled before the renewal date. By providing payment information, you authorize us (or our payment processor) to charge the applicable fees to your chosen payment method on a recurring basis.
6.3 Taxes
Fees are exclusive of applicable taxes unless stated otherwise. You are responsible for any sales, use, VAT, or similar taxes associated with your purchase, other than taxes based on our net income.
6.4 Refunds
We offer a 14-day money-back guarantee on new Pro License purchases. Refund requests after this period are handled at our discretion.
6.5 Failed Payments
If a payment fails, we may suspend or downgrade access to Pro features until payment is successfully processed.
7. Free Trials
If we offer a free trial of the Pro Version, the specific terms — trial length, what happens at expiration, and whether payment information is required upfront — will be disclosed at the time the trial is offered.
8. Intellectual Property Rights
8.1 Our IP
The Plugin, the Service, and all related trademarks, logos, and content provided by us (excluding your Content and any open-source components) are owned by Entreveloper.com or The Company, and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 4, these Terms do not grant you any rights to our intellectual property.
8.2 Open-Source Components
Portions of the Plugin may be distributed under open-source licenses (e.g., the GPL, consistent with WordPress plugin distribution requirements). Where an open-source license applies, its terms govern that portion of the code to the extent they conflict with these Terms.
8.3 Your Content
You retain all rights to the Content you create using the Service (e.g., word lists, crosswords, word searches, Checkered Force games, and future puzzles added to The Plugin). You grant us a limited license to process and store your Content solely as necessary to operate and support the Service. We do not claim ownership over your Content.
8.4 Feedback
If you submit feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose, without any obligation to compensate you.
9. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable local, national, or international law or regulation;
- Upload or generate Content that is unlawful, defamatory, obscene, hateful, or infringes on the rights of any third party;
- Transmit any viruses, malware, or other harmful code;
- Interfere with or disrupt the integrity or performance of the Service or any connected third-party service;
- Attempt to gain unauthorized access to the Service, other users’ Accounts, or related systems;
- Use the Service to generate content that violates a Third-Party Service’s own usage policies (e.g., an AI provider’s acceptable use policy).
We reserve the right to suspend or terminate access for any User who violates this policy.
10. Third-Party Services
The Plugin may integrate with or rely on Third-Party Services, including but not limited to:
- AI providers (e.g., OpenAI, Anthropic, Google Gemini) or self-hosted models (e.g., Ollama), used to generate word lists or puzzle content when you choose to enable AI-assisted features and supply your own API key or connection;
- Licensing and payments platforms (e.g., Freemius), used to sell and manage Pro Licenses;
- WordPress itself and the WordPress.org plugin directory.
Your use of any Third-Party Service is governed by that provider’s own terms and privacy policy, which we encourage you to review. We are not responsible for the acts, omissions, availability, or content of any Third-Party Service. Any costs charged by an AI provider for API usage are your sole responsibility and are separate from any fees paid to us.
11. Privacy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy, available at https://entreveloper.com/privacy-policy/, which is incorporated into these Terms by reference.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR FREE OF ERRORS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE SERVICE AND THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN YOUR LAST PURCHASE OF THE SERVICE, PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless Entreveloper.com, Nexterday Investment and Technologies, and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
15. Term and Termination
15.1 Term
These Terms remain in effect for as long as you use the Service.
15.2 Termination by You
You may stop using the Service at any time by deactivating and uninstalling the Plugin, and, for paid Licenses, by canceling your subscription through your Account or licensing dashboard.
15.3 Termination by Us
We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, fail to pay applicable fees, or if we discontinue the Service or a particular feature.
15.4 Effect of Termination
Upon termination, your right to use the Pro Version ends. Sections that by their nature should survive termination (including, without limitation, Sections 8, 12, 13, 14, and 19) will survive.
16. Modifications to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also revise these Terms from time to time. If we make material changes, we will provide notice (for example, via the Plugin’s admin interface, our website, or email) before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
18. Miscellaneous
- Entire Agreement. These Terms, together with our Privacy Policy and any License-specific terms, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
- Force Majeure. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control.
- Notices. We may provide notices to you via email, through the Plugin, or by posting on our website. You may contact us using the information in Section 19.
